Presentation of the project "Protection of the Rights of Persons Captured and Hostage"

On September 21 at at the Institute of Law and Human Rights of ANAS was held a final presentation of the project "Protection of the Rights of Persons Captured and Hostage, missing during the Armenian-Azerbaijani, Nagorno-Karabakh Conflict, in the Context of International Humanitarian Law" by Public Association for Assistance to Prisoners and Hostages "Hasret Yolu".

The event was organized with the support of the Council of State Support of Non-Governmental Organizations under the President of the Republic of Azerbaijan. It was attended by officials of the executive authorities of the occupied territories, prominent academic lawyers, persons who were prisoners and representatives of the media.

Opening the event, chairman of the Association Esmira Orujeva said that the project aims to investigate cases of tortures and violence of captive women and children by Armenians. She noted that a survey of 100 women released from captivity and persons who were held as hostages at a young age was conducted. Their age ranges from 28 to 70 years, and they are settled in the territories of Baku and Absheron, the villages and settlements of Agdam region and the settlement of Ashagi Agjakend of Goranboy region.

Referring to the results obtained on the basis of processed information resources and other information, as well as on the basis of the appropriate methodology for the analysis of the implementation of the project, it was established that the Armenian side, during the occupation of the Azerbaijani territories, violated international conventions and documents with respect to the civilian population taken hostage.

Thus, Armenians violated the second, third, fifth, ninth and 17 articles of the Universal Declaration of Human Rights, adopted by the UN General Assembly on December 10, 1948, the requirements of the Declaration on the Protection of Women and Children in Emergency and Armed Conflict adopted on December 14, 1974 Convention on the Prevention and Punishment of the Crime of Genocide, adopted on 9 December 1948, the Conventions on the Amelioration of the Condition of the Wounded and Sick in Armed Forces and on the Protection of Civilian Persons in Time of War, Part IV of the Protocol I) of 8 June 1977, added to the Geneva Convention of 12 August 1949 and devoted to the protection of victims of international armed conflicts.

All found violations of rights were sent to the UN High Commission for Human Rights and Refugees, the Head of the Committee against Torture of this Commission, the Secretaries General of the Council of Europe and NATO, the International Committee of the Red Cross, the European Union, including the OSCE chairpersons and embassies of all states accredited with Azerbaijan.

The event was attendant by head of the Institute of Law and Human Rights Institute Elshad Mirbashiroglu, head of the State Committee for Refugees and Forced Migrants Agalar Aliyev, head of the Military Prosecutor's Office of the Republic of Azerbaijan Emin Tagiyev, chief adviser of the State Committee for Refugees and IDPs, spoke about the violation of human rights and international conventions by Armenians. Problems of the family, women and children of Raid Emirbeyov, main teacher of Azerbaijan Medical University Aida Bendalieva, director of Khojali Secondary School No. 2 Fikure Rustemova and others. It was noted that, of the 1476 people released from Armenian captivity, 363 - women and 223 - children. It was pointed out that, being prisoners of Armenians, many of these people were subjected to torture and violence, physical and psychological pressure.
